What is a deed of sale for cars ?

The contract of deed of sale documents prove that you have bought or sold the car. It works like a recording and is also a useful piece of paper when problems arise in the future. WITNESSETH:

(the “Subject Vehicle”)

WHEREAS, the SELLER desires to sell the aforesaid motor vehicle and the BUYER is able, willing and ready to purchase the same under the terms and conditions herein below set forth;

NOW THEREFORE, for and in consideration of the sum total of _______________________________PESOS (PHP____________________), Philippine currency, receipt hereof is hereby acknowledged by the said SELLER, the SELLER hereby SELLS, CEDES, TRANSFERS and CONVEYS unto the BUYER, in a manner absolute and irrevocable the Subject Vehicle, free from any and all liens and encumbrances whatsoever and on an “AS IS WHERE IS BASIS”.

The SELLER warrants that the Motor Vehicle is free from any liens and encumbrances and that said SELLER shall defend the title and rights of the BUYER from any claims of whatever kind or nature from third persons.

The BUYER undertakes to cause the transfer of the registration papers of the Subject Vehicle immediately upon receipt of possession thereof, and the BUYER shall hold the SELLER free and harmless on a full indemnity basis against and from any charges, claims, damages, costs, judgment, decrees, expenses (including, without limitation, reasonable legal fees), penalties and liabilities of any kind or nature whatsoever which may be sustained or suffered by or secured against the SELLER by reason of, based upon, related to or arising out of the operation of the Subject Vehicle upon the execution of this Deed of Abolute Sale. 

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures on the date and at the place first above-written.
